Apple has told a US court that new evidence points to trade secret theft by OpenAI, alongside the alleged destruction of evidence linked to the case. The company has repeatedly urged the court to require expedited discovery, arguing that further delay causes additional harm.
The dispute centres on a lawsuit filed in July, in which Apple accused OpenAI of misappropriating confidential information. Two individuals were named in that filing, and Apple has maintained that the matter requires urgent attention.
What the new filing alleges
According to a filing submitted by Apple on Monday, the work MacBook used by Chang Liu contains a substantial amount of evidence that has allegedly been ignored by the defendants to date. Apple contends that OpenAI has been resisting its requests for expedited discovery, and now asserts that this resistance may reflect an active attempt to destroy evidence.
Employees and the wider dispute
Apple has stated that OpenAI recruited more than 400 employees from the company to work on artificial intelligence projects. Two of those individuals were specifically identified in the July lawsuit concerning the alleged theft of trade secrets.
Apple has continued to press for the court to order expedited discovery, arguing that every delay increases the potential harm to its interests. The company maintains that the evidence found on Chang Liu’s work MacBook supports its position that OpenAI is actively removing material relevant to the proceedings.
